Multi-Disciplinary Assessment Tool For The Management Of Stormwater In Malta
This tool was developed as part of Public Works Department’s participation as a Partner in the LIFE project titled ‘Optimising the Implementation of the RBMP in the Malta River Basin District’. It allows the user to examine the opportunities to address urban flooding by implementing green infrastructure. The user defines a site, then sets a goal of the volume of rain which will be captured or retained by adding green infrastructure improvements (best management practices or BMPs) to the area. BMPs are then added to the area and the tool presents feedback on the cost of construction and maintenance, in addition to estimating what percentage of the desired goal of volume retention is met. Additionally, co-benefits, including cost reductions and real estate value of these BMPs are calculated and presented to the user.

Definitions
“Software” means the software application consisting in the multi-disciplinary tool developed and provided by the Public Works Department and any modifications thereto made from time to time.
“User” means the person who has a licence to use the Software.
Limitation of Liability
The material displayed on the Software is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, the Public Works Department hereby expressly excludes and shall assume no responsibility or liability for:
– all conditions, warranties and other terms which might otherwise be implied by law.
– any errors or omissions in the content of the Software or for the results obtained from the use of the information contained in the Software.
– any special, direct, indirect, incidental or consequential or exemplary loss or damage incurred by the User in connection with the Software or in connection with the use, inability to use, or results of the use of the Software, any websites linked to it and any materials contained in it, including, without limitation any liability for loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted management or office time and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. Therefore, the Public Works Department shall not be liable for any damages which may arise as a result of any errors in calculations processed by the Software.
– any damage or alteration to the User’s equipment including, but not limited to, computer equipment, handheld device or mobile telephones as a result of the installation or use of the Software.

The Public Works Department gives the User no warranty or assurance. The Public Works Department declares and the User acknowledges that all implied warranties and conditions are excluded to the maximum extent permitted by law. In particular:

Intellectual Property
The Software and any modifications to it, as well as the underlying software code, shall at all times remain the intellectual property of the Public Works Department. All trademarks, service marks, corporate logos, copyrights, patents and any other specific contents created pertaining to the Software and software used shall always remain the property of the Public Works Department.
